Rules and Regulations

Articles of Association

In accordance with Article 110 of the Articles of Association of the Company, these Rules and Regulations are determined and published by the Board of Directors on the 26th Day of August 2013 and as amended 28th April 2015 and replace all prior sets of rules.

These Rules apply to all shareholders /occupants, their visitors, guests and tradespersons of The Coleman Savoy ("the building").

1. Articles of Association

The purchase of a group of shares entitling the shareholder/s to occupy a unit as allocated by Article 7. The following rules and regulations are compiled in accordance with Article 110 and any breach of these conditions may lead to the loss of occupancy rights and/or the forfeiture of the shares applicable to the unit.

2. Common Property

Common Property shall mean that part of the property owned by the Company which is not within a unit.

No alterations, including painting, are to be made to the common property including interior or exterior walls of the building. No trade, business or professional signage, notice or name board is to be affixed or exhibited on any part of the outside or inside of the building. Residents/shareholders may display temporary notices at the front door to inform or notify couriers and guests.

The right to occupy includes the right to use in common with all other residents/shareholders all hallways, passageways, stairways and other portions of the building including grounds surrounding the building which are available for the general use of residents/shareholders. These areas are subject to the requirements of the Fire Safety Standards and must be free of obstruction at all times. Items found obstructing these areas will be disposed of immediately.

Smoking is not permitted within the common areas of the building. It is an offence to allow smoke or fumes to drift into other units or common areas.

3. Deliveries

The delivery of any item, in particular furniture, is to be carried out between the hours of 8.00 am and 6.00 pm Monday to Saturday (excluding public holidays). Deliveries should be supervised and care should be taken at all times to avoid damage to common areas of the building. Particular care should be taken of French polished surfaces. Any damage caused will be costed and charged to the shareholder/s or resident/s concerned.

 4. Fire Safety

Observance and compliance with all requirements of Fire Safety set down in the attached schedule are required of all residents/shareholders. The fire doors are not to be propped open or automatic door closers interfered with in any way. Apartment front doors are fire doors and must be kept closed. Locks must comply with the requirements of the Australian Standards in regard to fire doors.

5. Floors

The floors in the units must be adequately covered or, in the case of exposed/polished floors soft footwear should be worn to ensure other residents/shareholders are not disturbed by noise. Heavy furniture should be kept next to walls to avoid point loading the centre of timber floors.

 6. Garbage

All garbage is to be secured and placed into bins provided. No rubbish is to be left in any common area of the building. Items for recycling are to be placed in the appropriate bins provided.

 7. Inspections

Upon twenty four hour's notice (with the exception of an emergency) being given to residents/shareholders of a unit, the residents/shareholders shall allow the Board of Directors, its agents or contractors to inspect the interior of the unit to test any electrical or plumbing installation for the purpose of tracing and repairing any defects. The Board of Directors reserves the right to effect a legal entry by recourse to a locksmith at the expense of the shareholder if such entry is not provided.

 8. Insurance Claims

Claims on the Company's insurance policy is required to be forwarded to the Board of Directors or its agent, within seven (7) days of its occurrence. It is recommended that all residents/shareholders take out insurances to cover damage to contents (including painted surfaces to internal walls) of their respective unit not covered by the Company's policy.

9. Laundry

To be used only between the hours of 7.30 am and 9.00 pm. Laundry facilities have been provided as an amenity for residents/shareholders only and not for non-residents/shareholders of the building. Consideration should be given to other users of the limited drying areas, and washing must be removed as soon as it is dry.

10. Lift

Care must be taken when moving in or out of the lift to ensure that damage does not occur. It is not permitted to transport bicycles in the lift. When moving furniture or large items in or out of the building arrangements must be made by contacting the Board of Directors or its agent for the protective curtains and mats to be installed.

11. Noise

No residents/shareholders shall make or permit to be made any objectionable noise in the building or interfere in any way with any other residents/shareholders peaceful enjoyment. No residents/shareholders shall have noise emanating from social gatherings in units or shared common property between the hours of  

11.00 pm and 8.00 am which interferes with the peace, quietness and enjoyment of other residents/shareholders.

12. Offensive Behaviour

No unruly, offensive behaviour or inappropriate language will be engaged on the property. All residents/shareholders shall be held fully responsible for the good conduct and behaviour of their guests and visitors.

13. Pets

The keeping of Pets in the building requires a written application to the Board for approval. Each shareholder application will be assessed on a case by case basis, and if successful, must follow approved agreed guidelines at all times.

14. Renovations

An application form obtained from the registered office must be completed and submitted to the Board prior to any structural or major renovations being made to any unit (including any alteration to gas, water or electrical installation). A damages contribution or bond may be required upon consent being given by the Board of Directors or its agent.

15. Air-Conditioning Units

The installation of external air-conditioning units requires Board approval. A written application should be submitted to the Board with attached installation schematics. The installation of air-conditioning systems should not impede upon the look or integrity of the building. All applications require Board approval prior to the works commencing, to ensure that all such measures have been taken to ensure minimal impact on the overall integrity of the building.  

16. Repairs

All repairs to company property must be authorised by the Board or it's agent. Only licensed tradespersons are permitted to carry out work in the building. Shareholders are required to supervise tradespersons at all times, in particular during delivery/removal of building materials. All defects in water, gas or electrical installations shall be promptly reported to the Board of Directors or its agent. A list of preferred licensed tradespeople is available from the Board of Directors or its agent.

Each shareholder/s shall be responsible for the interior maintenance and decoration of their unit. Taps, toilet flushers, internal drains, etc shall not be allowed to deteriorate, drip or leak into adjoining properties. The shareholder/s shall be responsible for the repair and renewal of such taps, toilet flushers and internal drains and are responsible for the replacement of all worn or broken washers, valves and clearing of internal drains at their own expense.

17. Residents

No unit shall be occupied without the prior approval of the Board of Directors or its agent. Visitors staying for extended periods should notify and seek the approval from the Board of Directors or its agent. Units are to be used for domestic purposes only and not as a commercial place of business.

18. Security

It is most important that the security of the building is maintained and care must be taken to ensure that the front door and side gate is locked at all times. No door is to be propped open unless there is a person in attendance. Do not allow access to the building or to any person not personally known to you.

18 Storage/Bike Room

There is limited storage space in the basement area for the use of residents/shareholders only. Property left there is at the owners' risk. The Company will not be held responsible for any loss or damage. No goods are to be placed directly onto the floor of the storeroom. Perishable items such as paper and cloth are to be stored in containers to avoid problems with damp, vermin, flooding and fire. Goods left in the storeroom must be clearly identified with name, unit number and the date stored.

An area has been allotted for storage of bicycles. All bicycles are required to be clearly identified. Access of bicycles must be through the side gate and not the main entry foyer.

Clearances are made yearly of the STORAGE/BIKE ROOM area and the Company will remove and dispose of any item/s that are not clearly identified or claimed.

19. Sub Tenants

In accordance with Article 7, the purchase of a group of shares entitles the member to an annual tenancy of the Company and in this regard any person, other than the shareholder, who resides in the building is regarded as a sub-tenant. The assignment of any sub-tenancy is on the same terms and conditions as the shareholder/s holds the unit as a tenant of the Company.

Shares are intended for purchase by owner occupiers. Subletting can only be allowed after two years’ occupancy by the shareholder/s. However, in certain extraordinary circumstances, this rule may be reviewed by the board. All proposed sub-tenants must be interviewed and approved by the Board of Directors or it's agent, after signing an agreement to abide by the Rules and Regulations of the Company. The shareholder's responsibilities are not diminished in any way and the shareholder/s must be easily contactable in the event of an emergency.

All sub-tenancies must be for a minimum period of 6 months.

20. Windows

Cleaning and replacement of glass in the windows will be the responsibility of the shareholder/s of each unit and these windows are to be kept in a clean and tidy condition to the satisfaction of the Board. No item, clothing or washing is to hang from any window or balcony, nor is anything to be thrown from any balcony or window.

Schedule (a)

What to do when the fire alarms are activated. The Fire Brigade will respond automatically but all residents need to observe the following procedures:

1. Reassure yourself that there is no fire in your own unit.

2. Make sure your neighbour is aware of the alarm but, for your own safety, do not delay leaving the building.

3. Evacuate the building by way of the main stairs right out to the street.

4. Wait for the all clear to be given by the Fire Brigade before re-entering the building.

Learning to live with smoke detectors

1. Smoke detectors are sensitive pieces of equipment and in addition to smoke can be affected by the following:-

a) Any aerosol sprays

b) Steam

c) Dust

d) Insects

e) Smoke from mosquito coils

2. Smoke detectors must not be tampered with in any way and must not be painted.

3. When renovation work of any description is being carried out within the unit, detectors must be covered to protect them from being affected by any dust, steam etc.

4. When showering, keep the bathroom door closed to stop steam entering the bedrooms and hallways.

5. When cooking, have the kitchen window open to allow excess steam and/or smoke from cooking to escape.

6. The occupant of the unit is liable for any costs incurred resulting from alarms within the unit caused by an activity of the occupant, their guest or tradesperson.

Fire Doors

The entry doors to each unit are one hour Fire Doors Systems that include the locks and the automatic closer. They are the property of the Company and must not be altered or interfered with in any way without the authority of the Company. Penalties may apply if any resident is found to be in breach of the regulations.  

These systems have been put in place, at great expense, for the protection of the residents of the building and you are reminded that any interference could result in this protection being reduced.
